Federal Law dated 11.07.2011 N 186-FZ "About ratification of Convention on legal status of migrant employees and members of their families"

 

 

The Convention between Belarus, Kazakhstan and Russia about legal status of migrant employees and members of their families, concluded on 19 November 2010 in Saint-Petersburg was ratified

 

 

Provisions of the Convention foresee significant simplification of the order of staying and performance of working activity in the territory of countries-parties of the Convention for migrant employees being citizens of one the countries of the Convention, who legally stay and work in the territory of the country of the other Party.

 

Particularly, the Convention provides the following preferences:

 

- the employer of the country of employment is granted the right to hire migrant employees without receiving of a special permit;

 

- migrant employees can conduct working activity in the countries-parties of the Convention without regard to established quota and without receiving a work permit;

 

- migrant employee and members of his family are freed from registration (registration at the place of temporary stay) in the authorised bodies of the country of employment within 30 days from the date of entering the territory of the country of employment;

 

- defining of the term of the temporary stay of the migrant employee and members of his family as the term of labour contract of the migrant employee with the employer;

 

- provision of the migrant employee with the right to conclude a new labour contract within 15 days, including, with the new employer in the order and on terms stated by the legislation of the country of the employment, in case of preliminary termination of the labour contract after 90 days from the date of entering the territory of the country of employment.
